This page shows our terms of service. If you do not agree with them then please do not purchase any of our products. You must agree in order to purchase. The terms of service is enforced for your benefit including keeping your account safe and stable. The use of services from Tech-Hosts constitutes agreement to these terms.
Prohibited Services
IRC is strictly prohibited from use on all of our servers. No exceptions.
The following services are prohibited from use on our shared hosting, reseller, and master reseller hosting accounts:
- Torrent Processes
- Copyright infringement
- SHOUTcast Servers (i.e. cast-control) and similar processes including game servers
- Shell/SSH/Telnet Scripts in any form
- IRC in any form
- Nulled/Illegal Scripts or Content
- Game servers
- Fraudulent or phishing content/scripts
- Stand-alone server side processes
- Any type of web spider or page indexer
- Cron jobs with intervals less than 15 minutes
Perl scripts are also forbidden on our shared hosting, reseller, and master reseller hosting accounts without explicit permission to run them.
The purpose of such prohibitions on these accounts is necessary in order to ensure an integrity of service for other server users. Therefore it may be found from time to time that processes not specifically mentioned above are also found to be unsuitable for use on these accounts. In such an event, Tech-Hosts will contact the customer to discuss options. Such processes may include, but are not limited to: Streaming Media Servers, ‘Teamspeak’ servers, proxy servers.
Virtual Private Servers can run any services/servers including but not limited to streaming media servers, Teamspeak servers, game servers, SHOUTcast servers. Our "Content" policy below also is enforced with Virtual Private Servers.
"Burst RAM" allows you to go over your guaranteed RAM usage for a short period of time. If you are constantly going over your guaranteed RAM allowance you may be forced to upgrade (you will be charged to upgrade the amount of guaranteed RAM you get on your VPS) or suspended until the issue is resolved.
Resource Usage
In order to maintain integrity of service for all users in a shared environment, it may be discovered from time to time that a certain account is not suitable for operation in a shared hosting environment on our servers. In this instance Tech-Hosts will contact the account holder to discuss options. Reasons for such action may include, but are not limited to: Sites operating scripts requiring a large amount of CPU or memory resource etc. If your account continuously goes over 20% of CPU usage, for example, we may have to help you move elsewhere. This is an unlikely event unless you are using powerful resource using scripts.
With SHOUTcasts, if you are using up to near the limit of your max listeners on a regular basis we may refuse to allow you to renew your product next month or cancel it immediately. This is to ensure that all our SHOUTcast customers can have a high quality level of service without any problems. If we choose to, we can reject to provide our SHOUTcast service to anyone at any time.
Content
Infringement of Copyright, Patent, Trademark, Trade Secret, or Intellectual Property Rights: Distributing and/or posting of the aforementioned infringements will not be tolerated. This includes warez, ROMs, mp3's, mpeg's or any other similar item that might violate one or more of these laws. Putting adult or similar images on your product is strictly against our Terms of Service. If you have content about a person, organization or event that the parties involves do not allow you to have or demand to be taken off your website, you must comply immediately or we will remove the content. This includes personal addresses, images and other personal details. If the images/details are technically not hosted on your website, but are shown on your website (i.e. iframes), this rule still applies. In all these circumstances we reserve the right to close your site without further notice.
Anything relating to hacking (i.e. guides, links, discussion, archives, forums, advice, promotion, etc.) is strictly prohibited.
You may not use your hosting or reseller product as an image/music hosting type of website (i.e. similar to Tinypic), nor may you use it as a file dump or mirror website (i.e. similar to Rapidshare). You cannot stream music/video hosted on your web hosting/reseller product. You are not allowed to use your hosting or reseller product as a backup or storage device. The only exception to this is up to 5 MySQL database backups and up to 2 cPanel backups at any time. Any other backups created of the account must be downloaded to another location and removed from the hosting product immediately. You cannot store backups from any other resource other than your hosting account under your hosting account.
If you wish to offer music downloads or stream music, for both hosting-based products and SHOUTcast products, you must contact us first to prove that you have permission from the authors to use their music and correct licenses in countries you provide the music to.
The following is strictly prohibited from ALL of our services unless an exception is explicitly agreed between the Client and Tech-Hosts:
- Any kind of IRC or IRC programs
- Fraudulent/phishing websites
- Pirated Software/Warez
- IP or Port Scanners
- Sale of any kind of chemical without in advance permission from Tech-Hosts
- Bruteforcing in any way
- Spam (i.e. mail spam) Scripts
- Lottery Websites (exceptions can be agreed)
- Hateful/Racist/Harassment oriented sites
- Hacker focused sites/archives/programs
- Sites promoting any kind of illegal activity
Server Abuse
Any attempts to undermine or cause harm to a Tech-Hosts server or customer is strictly prohibited. It may result in suspension or termination. If your account information is stolen and abuse is carried out, you are still responsible. This includes if your specific account has an attack, for example, a DOS attack and it uses an excessive amount of server resources.
Billing Policies & Refunds.
If for any reason it is not possible for us to complete one of our services (by service we mean one of the products listed on our website under the page/category of "services"), or you change your mind before the service is installed/created then a full refund will be given. We offer 1 week “cooling off” period on all hosting and reseller hosting packages during which you can cancel and receive a full refund. We also offer a 1 week "cooling off" period on certain VPS plans; Iron Linux VPS, Bronze Linux VPS, Silver Linux VPS, Gold Linux VPS and Platinum Linux VPS. We only give refunds for other servers (including other VPS packages) in exceptional circumstances. We do not refund domains under any circumstances.
If have previously ordered a product of a certain type, you cannot receive a refund on a new order of a product of the same type if you cancel it during the "cooling off" period.
PayPal subscriptions are the responsibility of the client. If the client cancels their product/service it is their responsibility to cancel their PayPal subscription. Tech-Hosts are not liable to refund subscription payments.
On our client system there is an option to add funds to your account (for example, add funds through PayPal as credit to your client account with us). Funds added through this system can not under any circumstances be refunded, as with the SMS and Landline Calls payments system.
Tech-Hosts bills clients for 1 calendar month, 3 months, 6 months or 1 year periods. If during the relevant period a customer cancels their account they will not receive any refund (unless during the 1 week “cooling off” period after ordering). This excludes services as they are one off payments and not regular payments. Customers cannot put their accounts on "hold" or "delay". Customers must prepay for the time they will use.
If payment is not received on the due date, Tech-Hosts reserve the right to suspend your account and can delete all remaining data after 3 days unless otherwise noted by our billing department. It is unlikely that we will terminate your account; we will give at least 24 hours warning unless otherwise decided. We reserve the right to suspend access to your account if you do not pay your monthly fee; we do send a reminder to you before you are due to pay via our client system. If you r payment is overdue and you pay it late, then the period for which you are paying will still have started on the date that the payment became due; it does not start from the day you pay the overdue payment.
We reserve the right to remove or modify services and in particular any special offer at anytime. We also reserve the right to cancel any service instantly should you break the terms of service in any way.
If you purchase one of our services and we request information regarding the service, you must respond within 14 days. If you do not, we reserve the right to cancel your service without refund.
Only payments via PayPal can be refunded. Payments via SMS and landline telephone call cannot be refunded under any circumstances, however, if you pay for a product or service using credit that has been added to your account via SMS or landline telephone call we can refund this back to your account as credit.
Valid contact details are required to use our service. This includes a valid name, address and telephone number. If valid contact details are not provided, these terms of service and other documentation become null and void in terms of Tech-Hosts' liability and we reserve the right to suspend or terminate your service at any time.
With regard to our price promise, a discount of the price of a plan is at the discretion of Tech-Hosts. A discount will apply for the first month only unless otherwise stated. The price promise will match the price you show by offering you the same service with a 10% discount. Proof of existence of a package to match the price to is required before we offer a discounted price.
Issuing of free bonuses including but not limited to free ClientExec licenses and free 0844 numbers is done at Tech-Hosts discretion. You may have to request your free bonus via support ticket. It is only possible to get a free bonus when you purchase a product. When that product is cancelled/terminated, your free bonus is too. Tech-Hosts reserve the right to cancel your free bonus at any time if we feel that we need to. Free bonuses are issued subject to availability.
If a ClientExec license is provided as a free bonus (with a product), you cannot have the domain it is licensed to changed beyond the initial issue of the license.
With regard to free 0844 numbers on selected plans, you must send in a support ticket requesting your number after your purchase. Your 0844 number can redirect calls to UK landlines only. You will be able to customize various parts of your line, and we will ask you questions regarding how you want it customized. An example is that you can choose the genre of your on hold music that your customers hear when on hold. 0844 numbers are issued subject to availability. 0844 numbers may not be able to be issued. In replacement, an 0843 number may be issued instead.
We offer a refund for any downtime at all (so guarantee 100% uptime). We guarantee to refund the exact amount of downtime that you have precisely. "Downtime" refers to any unscheduled downtime relating to our software/services - not data-centre network or hardware issues. We calculate downtime by dividing your monthly/quarterly/semi-annually/annually paid price relevant to the amount of downtime.
We offer discounts on recurring/renewal prices to clients from time to time to thank the client(s) for choosing us.
If you have the option and purchase or gain (a) dedicated IP(s), if the product relating to the dedicated IP(s) is terminated/cancelled, you will no longer be able to use the dedicated IP(s). Dedicated IP(s) cannot be refunded under any circumstance.
Any licenses that we sell with or without another product are strictly not liable for our refund policy and no refunds can be offered. In particular, cPanel/WHM, Fantastico, Softaculous and Installatron licenses cannot be refunded under any circumstances as these are bought externally and we cannot receive a refund for them. If you purchase a license or extra from us as an option/addon to a product, this license or extra is cancelled when your product/the parent product is cancelled.
Due to the structure and nature of all of our Windows VPS plans, we are unable to offer refunds under any circumstances on the Windows VPS product range.
We may increase domain renewal prices at any time despite what is advertised at the time of registration, although we will only do so when we are forced to due to an increase in fees we have to pay, and not to without reason/to solely increase profits.
The amount you pay for a hosting product will not change from the time of purchase. However, we reserve the right to change any of the pricings, plans and packages displayed on our website for new customers and orders.
Credit stored in a client area/billing area account will be automatically put onto an invoice if an unpaid invoice appears in the account. If the invoice is not due when the credit is added, the credit can be removed. However, if the date that the credit is added to the invoice is the date that the invoice is due, the credit will not be able to be removed from the invoice.
Products along with their invoices can be transferred between clients on request of the client that owns the product. However, products cannot be transferred back to their original owner by the original owner's request unless under exceptional circumstances or within 24 hours of the transfer.
Service Policies
Tech-Hosts reserves the right to revise, amend, or modify our Terms of Service and other policies and agreements at any time and in any manner.
If your product is not set up instantly or in the time limit stated when purchasing the product, this is an unusual error. Due to this, we reserve the right to not be held responsible if a product is not setup during the expected time or instantly. If there is a fault or error in the setup, we aim to have this corrected within 24 hours.
By registering as a Client of Tech-Hosts, you are unable to cancel your registration or have your account removed from our client records at any point unless a specific exceptional agreement is reached between the Client and Tech-Hosts.
Regular hosting plans cannot resell web hosting to other people under addon domains, sub domains, parked domaisn or any other method of reselling the hosting service. If you wish to resell hosting you must use a reseller or server.
Tech-Hosts reserve the right to suspend usage of any product we offer for any reason at any time. This is a precautionary measure and will be used if there is suspicion of or evidence of a breach of our terms of service.
Tech-Hosts are not responsible for errors of any type, but we will try and help you to fix them via support. We are not responsible to provide support for 3rd party products and software on any of our services.
We reserve the right to refuse service to anyone at any time.
To register as a client at Tech-Hosts and order any products, you must be in a position in your country to legally agree to this Terms of Service. If we have suspicion that you are not, we reserve the right to suspend or terminate any of your products unless you provide verification of your age in terms of a valid identification (e.g. passport) within the time frame we specify.
When we offer a "fully" or even "semi"/"partially" managed service for any of our serviecs, this is subject to the knowledge and experience which we are able to provide you with. If we are unable to help you with an issue, despite it being a managed service, we cannot be held liable to provide any form of compensation. We will always try to assist you to our best ability.
The Client agrees that Tech-Hosts may disclose any and all client information including assigned IP numbers, account history, account use, etc. to any law enforcement agent without further consent or notification to the client.
It is your sole responsibility to make sure your data gets backed up in case a crash does occur. If, in extreme circumstances, loss of data does occur, Tech-Hosts will work to recover the lost data. Tech-Hosts cannot be held responsible for data stored on their servers.
Tech-Hosts reserve the right to search through any and all files on its servers. If any files are found to break the Terms of Service, we reserve the right to remove, suspend or deal with these as may be required with the authorities. Tech-Hosts will in no way be held responsible for any files found on its server, which are uploaded by a customer.
If you connect to your SHOUTcast or any SHOUTcast in your account over the allowed/specified bitrate Tech-Hosts reserves the right to suspend or terminate your product.
If there is any abuse, mistreatment or threats to any Tech-Hosts staff of any kind, including use of foul language, Tech-Hosts reserves the right to suspend the account related to the abuse until further notice. We do not tolerate abuse and will take this rule very seriously. If you disclose the URL, location or content of your account or any support ticket, and/or such abuse to staff is given by somebody else, your account is still liable to this rule. This rule can also be enforced on you if you are involved with abuse on someone else’s support ticket. Please keep all information you are given confidential.
Spam from your account onto any of our systems, including our support ticket system, may result in suspension of service, termination or refuse to provide support.
Should we be required to display logs of chat/support tickets anywhere, we reserve the right to display this information including content of a support ticket or chat logs of a conversation on any chat client with any of our staff.
Spam
Sending of unsolicited e-mail, bulk emailing, and spam in any form is strictly forbidden from all of Tech-Hosts services. We also refuse to host any website which is advertised by methods of spam including but not limited to spam via email, instant messaging, discussion boards, telephone or fax.
Tech-Hosts reserves the right to charge the user for blacklist removal or other costs incurred by misuse (i.e. spamming) from their account, whether the spam was intentional or unintentional.
Disclaimer
Tech-Hosts will not be responsible for any damages of any kind that you or your business may suffer as a result as a result of using its services. This includes but it is not limited to loss of data and any service interruptions. It is very unlikely that such data loss or disruption will happen, and we will always undertake everything within our control to prevent such an event. You hereby agree not to hold Tech-Hosts responsible for any such claims.
Modification
Tech-Hosts reserves the right to add, delete or modify any provision of its Terms of Service at any time without prior notice.
